I – Application and opposability of the general terms and conditions of sale
1.1 - The present general terms and conditions of sale are brought to the attention of each customer to allow them to place an order.
1.2 - Therefore, this implies full, unreserved acceptance by the customer of these general terms and conditions of sale.
1.3 – No special condition originating from the customer may prevail over the present terms and conditions.
II – Orders and confirmation
2.1 – The customer undertakes to fill out the ordering form accurately. In the event of a mistake in the spelling of the recipient’s address details, Bons Biscuits de France cannot be held responsible if it is impossible to deliver to the recipient or if the goods need to be returned to Bons Biscuits de France . If the customer wishes to have the package re-routed to another address, he must pay the extra charges.
2.2 – Each order is subject to our acceptance. The items presented on our e-Shopping website may under no circumstances be subject to requests to modify their composition or their presentation.
For orders higher than 150 € excluding delivery costs, Bons Biscuits de France reserves the right to reject the order and ask you to contact us by email at contact@bons-biscuits-de-france.com in order to follow a procedure that is more appropriate to the volume requested. The same procedure is to be followed for requests relating to commercial relations with professionals or shops.
2.3 - As of confirmation of the credit card data on the interface of our partner bank, the order is considered as irrevocable and may not be challenged.
The order is definitively accepted only after confirmation of the payment of the amount corresponding to the order. Therefore, the order will only be handled after effective receipt of payment to Bons Biscuits de France.
The seven-day cooling-off period does not apply to contracts for the supply of perishable foodstuffs such as biscuits and confectionary.
III – Prices and delivery charges
3.1 – The prices indicated on the order form are in €uros, VAT inclusive, ex warehouse at the company in Ginestas (11120 – France). The VAT rate of 5.5% applies to orders destined for mainland France and overseas territories, Corsica, and the countries of the European Union. In accordance with the legal requirements, certain items may be subject to a VAT rate of 19.6%. The prices indicated on this site may be revised in the course of the year owing to the variability of the cost of our raw materials.
3.2 – The delivery costs are to be paid on top of the sale price. We use a system of brackets to determine the volume of the package and the resulting price, which also depends on the weight of the package. Moreover, these delivery costs take into account the postage and packing.
We use either La Poste’s Colissimo service, with evidence of the deposit and delivery for a signature, or with Chronopost for the following countries:
Mainland France (including Corsica), Andorra, Monaco, French overseas departments and territories, the European Union (with the exception of Estonia, Latvia, Lithuania and Malta), Norway, Switzerland, Algeria, the Ivory Coast, Egypt, Israel, Morocco, Tunisia, Canada, Australia, China, South Korea and Japan.
For all others countries, apart from those which we do not serve, we exclusively use Chronopost.
The delivery periods are: for mainland France, 48 hours with the Colissimo service and 24 hours with Chronopost; for other countries, from 4 to 8 days with the Colissimo Service and from 1 to 6 days with Chronopost. These periods are given for information only. No compensation may be claimed for late delivery.
3.3 – For legal reasons concerning the importation of foodstuff, it is impossible for Bons Biscuits de France to deliver products to the United States.
3.4 – Import duties: there are no import duties within the European Union. For all other countries, any taxes or customs duties are to be borne by the recipient and must e paid on delivery.
IV – Payment on order
4.1 – The payment is made online by credit card: Carte Bleue, Visa, Eurocard, Mastercard, either via our bank service (up to €150) or via our provider PayPal. Credit transfer is also possible.
4.2 – The currency used for the transaction is the €uro. The amount debited from the account of the credit card used will depend on the rate of the €uro on the day of the debit and on any exchange costs charged by the bank issuing the card.
4.3 – The order is only definitively accepted after confirmation of payment of the amount corresponding to the order. Therefore, the order will only be handled after effective receipt of payment by Bons Biscuits de France.
4.4 – The customer must indicate his or her card number, the expiry date and the last three figures of the pictogram featuring on the reverse side of the card. The SSL protocol used guarantees total confidentiality of personal data transmitted over the internet.
V – Unavailability of products
5.1 – We can supply our entire product line all year long, except for seasonal products (e.g. marrons glacés (candied chestnuts)). The availability of products will be specified where applicable on our online shop.
VI – Delivery of products
6.1 – The items are prepared and packed by Bons Biscuits de France in a shock-resistant closed package during transport.
6.2 – The customer is responsible for the indications given when the order is placed (full address, storey, door code, telephone, etc.). Bons biscuits de France may not be held responsible for an undelivered package owing to incorrect indications. If the package is returned to us because of this type of problem, the re-delivery will be invoiced in full to the customer.
6.3 – WARNING: orders indicating a P.O. box address will not be handled.
6.4 – After confirmation of payment, Bons Biscuits de France undertakes to process and send the order to the destination indicated in accordance with the procedure and means of transport we have determined.
Orders received via the internet, after acceptance of payment by the credit card centre and effective receipt by Bons Biscuits de France, are prepared and dispatched within 48 hours. However, in peak periods (15 to 24 December), lead times may not necessarily be guaranteed.
The lead time for receipt of the packages from Bons Biscuits de France is 48 hours. Once this period has elapsed, you can consult the website of La Poste (www.laposte.fr) or Chronopost (www.chronopost.fr) where you will find the situation concerning your package via the dispatch number given to you when your order is confirmed.
6.5 – If the recipient is absent, a non-delivery notice will be left in his or her letterbox. The package should then be collected as soon as possible from the given address. Bons Biscuits de Fance may under no circumstances be held responsible for any deterioration of the products owing to late collection from the post office.
6.6 – With the aim of sending you our chocolates in the best possible conditions, we dispatch orders only on Tuesdays, Wednesdays and Thursdays to ensure they are not stored in warehouses or other places unsuitable for their conservation.
6.7- Under no circumstances can we be held responsible for any damage to the products if the package has been opened during transport, or if the recipient is absent when the package is delivered.
6.8 - The customer must ensure the delivery conforms to the order. In order to be handled, any claim must be made within 48 hours following receipt (contact at contact@bons-biscuits-de-france.com). The goods are transported at the risk of the recipients, since ownership is transferred to them upon acceptance of the order.
VII – Replacements and refunds
7.1 – No returns, refunds or replacements will be granted.
7.2 – No claim may be made by the customer concerning the taste, freshness or appearance of the products.
VIII – Obligation of the customer
8.1 – All orders must be destined for personal use.
Resale and use or transformation of our products for any commercial purpose is strictly prohibited without our authorization.
IX – Confidentiality of data
9.1 – With the purpose of protecting your privacy, Bons Biscuits de France keeps all data concerning you strictly confidential. When you purchase, we only ask you for the information that is indispensable for your order (surname, forename, full address, e-mail). This data entered online is saved to a secure server and is immediately encrypted.
9.2 – In accordance with the French Information Technology and Liberty law of 6 January 1978, you have the right to access and rectify the data that concerns you.
To exercise this right and to receive the information, you can contact Bons Biscuits de France at contact@bons-biscuits-de-france.com. In case of error or modification, it may be rectified.
X – Independence of clauses - Force majeure – Applicable law
10.1. If one of the present general terms and conditions should be declared inapplicable or invalid for any reason, this invalidity or inapplicability will not affect the application or validity of the other provisions in these general terms and conditions, and the clause that is invalid or deemed inapplicable will be replaced by the closest possible provision.
10.2. Neither Bons Biscuits de France nor the customer may be held responsible for any non-fulfilment or delay in fulfilment of one of its obligations described in the present general terms and conditions of sale if such non-fulfilment or delay is due to a case of force majeure.
10.3 - Force majeure means any external, unforeseeable and uncontrollable event within the meaning assigned by article 1148 of the French Code Civil, including, without being limited to: total or partial lock-outs or strikes, war, weather conditions, epidemic, blockade of transport or supply means for any reason whatsoever, earthquake, fire, storms, flooding, etc.
10.4 - The present general terms and conditions are governed exclusively by French law. The Narbonne Business Tribunal is the only body competent to deal with any litigation or dispute arising from them.
